Terms of Use
These Terms govern your use of The Way mobile application. Please read them carefully. By creating an account or using the app, you agree to these Terms.
1. Who we are
The Way is a mobile application owned and operated by Secupeer Technologies ("we", "us", "our"). Contact: thewaywehandlethings@gmail.com .
2. Eligibility
You must be at least 18 years old to create an account or use The Way. By using the app, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
3. What the service is, and is not
The Way connects you with mentors and trusted advisors to discuss questions and challenges in your life. Responses you receive through the app are general guidance offered in good faith by mentors and authorized staff. They are not:
- professional legal, medical, psychiatric, or financial advice;
- a substitute for licensed therapy or counseling;
- emergency services or a crisis response service.
If you are in an emergency or are at risk of harm to yourself or others, do not use the app. Contact your local emergency number (such as 911 in the United States and Canada) or a recognized crisis line immediately.
4. Your account
You are responsible for the security of your account. Keep your password (or the credentials of the Google account you sign in with) confidential. Notify us promptly if you suspect unauthorized access at thewaywehandlethings@gmail.com .
You may not:
- create an account using someone else's identity;
- share your account with another person;
- create more than one account for the same individual without our consent.
5. Acceptable use
When using The Way, you agree not to:
- submit content that is unlawful, threatening, harassing, defamatory, obscene, or that infringes on someone else's rights;
- harass or abuse mentors, other users, or our staff;
- upload attachments that contain malware, illegal content, or unauthorized confidential information about a third party;
- attempt to gain unauthorized access to the app's backend, other accounts, or our infrastructure;
- use the app for any commercial solicitation, spam, or to send unsolicited communications;
- use the app in a way that could disable, overburden, or impair its operation.
We may suspend or terminate accounts that violate these rules, with or without notice.
6. Your content
You retain ownership of the requests, descriptions, and attachments you submit through the app ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, and display Your Content as needed to operate the app and to share it with the mentors and authorized staff who review and respond to your request.
This licence ends when you delete Your Content or your account, except to the extent that we are required to retain copies for legal compliance.
You are responsible for Your Content. Do not submit anything you do not have the right to share.
7. Intellectual property
The app itself, including its design, source code, brand, and the materials we produce, is our property or licensed to us. You receive a limited, personal, non-transferable licence to use the app for its intended purpose. You may not copy, modify, reverse-engineer, sublicence, or redistribute any part of the app.
8. Third-party services
The app uses Google's Firebase platform for backend services and Google Sign-In as one of the sign-in options. Your use of these third-party services is governed by their own terms and privacy policies.
9. Disclaimers
The app and the responses you receive through it are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, secure against every threat, or that any specific outcome will result from your use of it.
10. Limitation of liability
To the maximum extent permitted by law, in no event will we, our affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including loss of data, loss of profits, or harm resulting from actions you take based on guidance received through the app.
Our total liability to you for any claim arising out of or related to these Terms or the app will not exceed one hundred Canadian dollars (CAD 100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Termination
You may stop using the app at any time and may delete your account from the Settings tab. See Account Deletion for what happens when you do.
We may suspend or terminate your access to the app at any time, with or without notice, if we reasonably believe you have violated these Terms or that suspension is necessary to protect the app, its users, or our staff.
13. Changes to the app and these Terms
We may modify, add, or remove features of the app at any time. We may update these Terms from time to time; when we make a material change, we will update the "Last updated" date at the top of this page and, where appropriate, notify you within the app. Your continued use of the app after a change indicates acceptance of the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles.
You agree that the courts of British Columbia have exclusive jurisdiction to resolve any dispute arising out of or related to these Terms or your use of the app, subject to any mandatory consumer protection rules in your jurisdiction.
15. Severability
If any part of these Terms is found to be unenforceable, the rest remains in effect.
16. Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the app and replace any prior agreements on that subject.
